一、认定标准
The identification norms for blacklisted suppliers
(1)若发现供应商(含代理商)有资质造假、诚信欺诈、与长电科技总部及各个工厂利害关系人存在内幕交易、严重违反供应商诚信声明、危害国家安全等情形的,供应商将被列入黑名单.
If suppliers (including agents) are found to be qualified for fraud, integrity fraud, insider trading with stakeholders of JCET Group, serious violation of integrity industry cooperation agreement, endangering national security, etc., suppliers will be blacklisted.
(2)严重违法违规受到重大刑事处罚、行政处罚或者引发严重质量事故、生产安全事故的供应商;
Subjected to significant criminal or administrative penalties due to serious violations of laws and regulations;
(3)引发突发环境事件、生态损害赔偿等环保事件;
Triggering environmental emergencies, ecological damage compensation, and other environmental protection incidents;
(4)提供重要虚假材料谋取成交、围标串标、利用商业贿赂及其他不正当手段谋取利益等严重破坏市场公平竞争和社会正常秩序。
Providing important false materials to secure a deal, engaging in bid-rigging and collusion, using commercial bribery and other improper means to seek benefits, and other serious acts that undermine fair market competition and normal social order.
(5)对生产经营造成重大影响相关情形。
May causing significant impacts on production and operation
可能对长电科技总部及各个工厂资产、负债、权益和经营成果产生重大影响。其中预计损失是指虽尚未形成事实资产损失,但确有证据证明资产损失在可预见未来将发生,且能可靠计量资产损失金额的。
It may have a significant impact on the assets, liabilities, equity and operating results of JCET and its subsidiaries at all levels. Among them, the expected loss refers to the situation where, although no actual asset loss has been formed yet, there is solid evidence proving that the asset loss will occur in the foreseeable future and the amount of the asset loss can be reliably measured.
可能导致长电科技总部及各个工厂生产经营条件和市场环境发生特别重大变化,影响可持续发展,包括但不限于在财务、经营等方面对持续经营能力产生重大疑虑的事项或情况。
Matters or circumstances that may cause particularly significant changes in the production and operation conditions and market environment of JCET and its subsidiaries at all levels, affecting sustainable development, including but not limited to those that raise significant doubts about the company's ability to continue operating in terms of finance, operation, etc.
(6)长电科技总部及各个工厂根据所在企业实际经营情况,确定的其他认定标准。
Other recognition criteria determined by the headquarters of JCET and each factory based on the actual operating conditions of the enterprises where they are located.
二、处置规则
Rules for Disposing of Blacklisted Suppliers
(1)黑名单供应商和个人的单次惩戒期限为五年。
The single disciplinary period for blacklisted suppliers and individuals is five years.
(2)对禁用期结束且在期限内完成整改并承诺依法合规开展业务的长电科技境内总部及其在中国境内工厂黑名单供应商及个人,经原申报单位审查通过后,按新供应商导入流程,重新导入,导入流程结束后移出黑名单清单。对禁用期结束时仍未完成整改的,按照单次惩戒期限五年,自动延长一个惩戒期限,直至整改符合要求。
For suppliers and individuals on the blacklist of JCET's domestic headquarters and its factories in China that have completed rectification within the ban period and committed to conducting business in accordance with laws and regulations, after being reviewed and approved by the original reporting unit, they will be re-introduced in accordance with the new supplier introduction process. After the introduction process is completed, they will be removed from the blacklist list. For those who have not completed the rectification by the end of the ban period, the disciplinary period will be automatically extended one single disciplinary period of five years until the rectification meets the requirements.
(3)列入长电科技JSRM“供应商黑名单”的供应商或个人积极整改、消除不良影响的,以及确有正当原因的,可以减轻对其的处理,按照新供应商导入流程申请,导入后可提前从黑名单清单中移出。减轻处理后,实际惩戒时间原则上不得少于原惩戒时间的二分之一。
After being blacklisted by JCET, if the supplier or individual actively rectifies and eliminates the adverse effects, or if there are indeed legitimate reasons, the handling of them can be mitigated and they can be removed from the JCET blacklist in advance. After mitigation, the actual disciplinary period shall, in principle,not be less than half of the original disciplinary period.
